To: Trendy Playhouse Inc., its directors, officers, employees, agents, volunteers and assigns (collectively, “Trendy Playhouse”),

In consideration for my (child’s) use of Trendy Playhouse’s rental equipment, including without limitation all inflatables, soft play items, play areas, fences, mats, block, pits, slides or other equipment, tools, or accessories (the “Equipment”), and on behalf of myself (my child), my heirs, executors, successors, assigns, and whomever may have or acquire any interest in any claim arising from the use of the Equipment, including but not limited to any minors (collectively, “I / my”), I agree to the following terms:
1. I will abide by Trendy Playhouse and the manufacturers’ instructions at all times, and I understand the proper use of the Equipment.
2. I voluntarily accept and assume all risks, dangers and hazards associated with the use of the Equipment, including without limitation injury, death and damage to or destruction of property. Accordingly, my use of the Equipment is entirely at my own risk.
Waiver of Claims, Release of Liability, and Indemnity Agreement
3. I hereby waive all claims I may have and that may arise against Trendy Playhouse in association with my use of the Equipment.
4. I hereby release Trendy Playhouse from all liability, including without limitation, for any injury, death, damage or expense, that I may suffer in association with my use of the Equipment, howsoever arising, including negligence, breach of contract or breach of statutory duty of care, or in respect to the selection or maintenance of the Equipment or in respect to the provision or failure to provide any warnings, directions or instructions as to the use of the Equipment or the risks, dangers and safety and hazards of the use of the Equipment.
5. I hereby indemnify and save harmless Trendy Playhouse from all liability, including without limitation, for any injury, death, damage or expense, to myself, my child, or any third party, howsoever arising, resulting from my (child’s) use of the Equipment.
I have read and I understand this Assumption of Risks, Waiver of Claims, Release of Liability and Indemnity Agreement, and I am freely signing it.
